ADA violations to be made public under McConchie legislation signed into law

In an effort to provide transparency regarding the number of public buildings that are not compliant with the Americans with Disabilities Act (ADA), Gov. Pritzker signed State Senator Dan McConchie’s (R-Hawthorn Woods) legislation that requires the Attorney General to post data on ADA violations.

Senate Bill 1090 requires that the data must include:

  1. The total number of open compliance investigations each year
  2. The ten most frequent complaints received under the ADA that are under investigation each year
  3. The total number of complaints received under the ADA each year

“As someone with a disability myself, I’m proud to champion this legislation and fight for disability rights,” said Sen. McConchie. “Currently there are no collection or reporting requirements regarding physical access violation complaints to the Attorney General. The intent of this new law is to provide that information in an effort to ensure that every disabled person has equal access to facilities across the state.”

Under state and federal law, people with disabilities are entitled to fair and equal opportunities in all aspects of life including equal access to buildings, housing and services.
